Some of you may remember our friend Ben Ginsberg. Ginsberg's prior hits include his time as Chief Counsel for Bush/Cheney '00 (including the recount litigation), and his aborted stint as Chief Counsel for Bush/Cheney '04. Ginsberg was forced to leave the second campaign after it was revealed that he had
illegally represented the Swift Boat Veterans while also working for the campaign.
Well, ol' Ben's gotten a little older, and he's forgotten the first rule of legal ethics: don't say anything that hurts your client.
Ginsberg gave a speech at the Duke Law School today, and in a moment of unintentionally honesty, he told his audience what Republicans really think about the Constitution:
Just like, really, with the Voting Rights Act, Republicans have some fundamental philosophical difficulties with the whole notion of Equal Protection.
Video of the speech is available here, and the quote appears at about 38:30. Furthermore, the quote is just as damning in context. Ginsberg was speaking about the winning Equal Protection argument used in Bush v. Gore, and commenting on how many of his Republican cohorts did not approve of that argument, because they are opposed to Equal Protection itself.
